numbering footnotes

Hello xslt-programmers,
I want to numering footnotes like it's described in the code below.
With cocoon it works very well, but with IE5.5 and MSXML from 9.5.2000 it doesn's do the same.
It tells me always that the data who is needed to process this is currently not available.
I have find out, that
<xsl:number level="multiple" count="fussnote"/>
do not produce that error.
So my question:
DOES THE MSIE AND HIS PARSER DO NOT SUPPORT THE LEVEL-ATTRIBUTE ANY?
IS THERE AN OTHER POSSIBILITY TO NUMBER THE FOOTNOTES DESCENDANT?
