Why does that mean you have to use nbsp ?

  is perfectly valid HTML.

Also if you are using the html output method (which is the default if
your top level result element is <html>) You will probably find that
your XSL system outputs the character 160 as &nbsp; anyway, without
any other hint in your stylesheet.
