The DTD contains the declaration
<!ATTLIST html
%InternationalAttributes;
xmlns %URI; #FIXED
"http://openebook.org/namespaces/oeb-document/1.0/"
xmlns:xlink %URI; #FIXED "http://www.w3.org/XML/XLink/"

I.e. with DOCTYPE the html element is in the namespace "http://openebook ...",
without it it's in the null namespace.
