IANAL but this is "non-free" for a reason: the license is not
OSI-compliant and therefore cannot be distributed when built for
Cygwin[1].  Feel free to build it for yourself if you accept their
terms, but AFAICS this cannot be added to the distro.

BTW, before you ITP more packages, perhaps you could better maintain the
134 you already have[2]?  For example, I asked six weeks ago[3] for a
xmlto update (--with-backend=dblatex, please[4]) and again this week[5]
and have not seen so much as a response.
