vim 5.0h with error message

I use the latest cygwin.dll (Sept97) from Sergey with Win95.
Now vim is running, great !! Older versions had
forced vim so slow, that Win95 nearly standed.

I set "TERM = linux" but get the following message
after starting vim:
Bad escape 124 (|)

Any ideas? Thanx,
